What is a Divorce Decree?
A Divorce Decree is the court document that legally terminates a marriage. It is issued by a court and confirms the judicial act through which the marriage has been dissolved.
Depending on the country and legal system, the document may be called Divorce Decree, Divorce Order, Final Judgment of Divorce, Final Order of Divorce, Judgment of Dissolution or another similar term. The exact wording matters because it indicates the legal function of the document.
Divorce Decree vs. Divorce Certificate
A Divorce Decree should not be confused with a Divorce Certificate. In many countries, a Divorce Certificate is only an extract from a civil registry or an administrative confirmation that a divorce has been registered.
The decree, however, contains the actual judicial decision. For recognition in Germany, authorities often need the full court decision rather than a short certificate that merely confirms registration.
Recognition of a foreign divorce in Germany
Under German law, divorce is treated as a judicial act (gerichtliche Entscheidung). When a marriage has been dissolved abroad, German authorities may require official recognition of the foreign divorce (Anerkennung einer ausländischen Scheidung).
Without the Divorce Decree, it may be impossible to remarry, update civil status records, clarify name use, complete certain residence procedures or assert legal rights in Germany.
Why German authorities usually require the full decree
The full Divorce Decree shows which court decided the case, who the parties were, when the decision was issued, what exactly was ordered and whether the divorce has become final.
A short certificate may not show enough information for recognition. It may omit the legal reasoning, operative provisions, finality wording, custody provisions, property matters or other elements that the German authority needs to review.
Rechtskraftvermerk: proof that the divorce is final
For recognition in Germany, the decree must usually include confirmation that it has become legally binding. In German, this is commonly referred to as a Rechtskraftvermerk.
In English-language documents, this may appear as final, absolute, entered, filed, certified copy, no longer subject to appeal or through other court-specific wording. The translation must reflect the finality status precisely and without adding assumptions.
What information may be contained in a Divorce Decree?
A Divorce Decree may contain the names of the spouses, court name, case number, date of judgment, date of entry, finality wording, orders on divorce, custody, parental responsibility, child support, spousal support, property division, costs and other provisions.
It may also contain seals, signatures, clerk certifications, electronic filing notes, schedules, annexes, apostilles, certification pages or references to related court orders.
Divorce Orders from the United Kingdom
In the United Kingdom, modern divorce documents may be called Conditional Order and Final Order. Older terms such as Decree Nisi and Decree Absolute may also appear in historical documents.
For German use, the translation must make clear whether the document is a preliminary step or the final order legally ending the marriage. This distinction is essential for recognition and civil status procedures.
Divorce documents from the United States
In the United States, terminology varies by state. Documents may be titled Final Judgment of Divorce, Judgment for Dissolution of Marriage, Divorce Decree or Decree of Dissolution.
U.S. court documents may also include property settlement terms, custody orders, child support, alimony, restoration of a former name or certification by a clerk of court. These elements must be translated accurately if they are part of the submitted document.
Canada, Australia and other English-speaking countries
In Canada and Australia, documents may be titled Divorce Order, Divorce Judgment, Final Divorce Order or similar terms depending on the court and jurisdiction.
Even when documents appear similar, legal terminology can differ. A certified translation must preserve the wording of the original and make its legal effect understandable for the German recipient.
Why sworn translation is required
German authorities usually accept only sworn or certified translations for foreign court documents. The translation must be prepared by a translator who is authorized to certify translations for official use.
A sworn translation confirms that the translation is complete and accurate. It helps the receiving authority rely on the translated content when assessing the foreign divorce.
Apostille, legalisation and certified copies
